Abstract

RESUMEN: Esta investigación analizar los motivos, que impiden el pleno desarrollo del Derecho a la Verdad y el acceso a la jurisdicción, por medio de la jurisprudencia salvadoreña. Como podrá evidenciarse en esta investigación, existe basta teoría y doctrina dedicada a definir lo que se va a entender por verdad, como un derecho fundamental, la sentencia objeto de este estudio hace un abordaje más integral del Derecho a la Verdad como un derecho fundamental, cuya eficacia depende de la existencia y funcionamiento de los mecanismos, tanto dentro de la legislación salvadoreña como fuera del territorio, por medio de los instrumentos internacionales de los cuales, cualquier ciudadano de un determinado Estado, suscrito a estos instrumentos puede hacer uso de ellos; tal como puede evidenciarse en los diversos casos que se mencionan en la presente investigación, los cuales han sido llevados ante la Corte Interamericana de Derechos Humanos, para obtener una respuesta favorable a sus peticiones. ABSTRACT: This research will analyze the reasons that prevent the full development of the Right to Truth and access to jurisdiction, through Salvadoran jurisprudence. As can be seen in this research, there is enough theory and doctrine dedicated to defining what is to be understood as truth, as a fundamental right, the sentence object of this study makes a more comprehensive approach to the Right to Truth as a fundamental right, The effectiveness of which depends on the existence and functioning of the mechanisms, both within Salvadoran legislation and outside the territory, by means of the international instruments of which any citizen of a certain State, subscribed to these instruments, can make use of them; as can be seen in the various cases mentioned in this investigation, which have been brought before the Inter-American Court of Human Rights, to obtain a favorable response to their requests.
