Abstract

RESUMEN: La presente investigación se basa en el estudio y análisis del derecho fundamental a una pensión digna, como una categoría del derecho a la seguridad social, desde la perspectiva de la reforma estructural del sistema de pensiones que entró en vigencia en el año 1998. En un primer momento se regulo un sistema de pensiones público, pero con la reforma mencionada se pasó a un sistema de pensiones privado, por lo que se estudia las consecuencias que esto trajo para todos los cotizantes y pensionados en su derecho a una pensión digna. OBJETIVOS. Analizar el efecto que provoco la privatización del sistema privado pensiones. evaluar en qué medida la exigibilidad y justiciabilidad constituyen una herramienta ineludible para lograr la tutela efectiva del derecho fundamental a una pensión digna. CONCLUSION. la privatización del sistema de pensiones si presento una regresividad en cuanto a la tutela y goce del derecho fundamental a una pensión digna. Y para lograr una pensión digna se concluyó que desde un punto teórico la exigibilidad y justiciabilidad si es una herramienta ineludible para la tutela del derecho a una pensión digna, pero que en la práctica jurídica es escaso el uso de estas dos herramientas.
