Abstract

RESUMEN: La presente investigación investigó la determinación y ejecución de la pena en el sistema penal juvenil salvadoreño, para revisando el trabajo que desarrollan los órganos, organismo, instituciones del Estado, organizaciones civiles y sociales que intervienen en materia de seguridad y prevención del delito de las conductas antisociales de los jóvenes salvadoreños. Metodología: la investigación se desarrolló por medio de entrevistas a autoridades de los principales entes estatales que están directamente ligados con la problemática (Juzgados de Menores, Juzgados de Ejecución de Medidas al Menor, Cámara de Menores de la ciudad de San Miguel) asimismo, la Procuraduría para la Defensa de los Derechos Humanos de la ciudad de San Miguel. Conclusiones: Se pudo comprobar a través de la investigación de campo, que hace falta preparación y como consecuencia existe un desconocimiento en materia de menores por parte de los operadores jurídicos fiscales y defensores. Respecto a los profesionales jurídicos en materia penal juvenil, quedó comprobado en su mayoría el desconocimiento de las reformas a la Ley Penal Juvenil. Las penas de la Ley Penal Juvenil, son la expresión de factores políticos mediáticos como políticas del órgano Ejecutivo para enfrentar la criminalidad juvenil por medio de los Planes mano dura. Las los delitos que se ejecutan mediante a la Ley Penal Juvenil son el resultado de una formulación de políticas criminales pero estrictamente represivas, dejando a un lado el elemento más importante de la infancia y la adolescencia, que consiste en la prevención donde no se cuenta con una política adecuada preventiva para la delincuencia juvenil. El Principio de Mínima Intervención se ve violentado al criminalizar todos aquellos delitos menos graves, cerrando la posibilidad de evitar en la medida de lo posible que los niños, niñas y adolescentes acudan a instancias judiciales. ABSTRACT: This investigation investigated the determination and execution of the sentence in the Salvadoran juvenile penal system, in order to review the work carried out by the organs, agencies, State institutions, civil and social organizations that intervene in matters of security and prevention of the crime of the antisocial behaviors of young Salvadorans. Methodology: the investigation was developed through interviews with authorities of the main state entities that are directly linked to the problem (Juvenile Courts, Juvenile Execution Courts, Juvenile Chamber of the city of San Miguel) as well, the Attorney for the Defense of Human Rights of the city of San Miguel. Conclusions: It was possible to verify through the field investigation, that preparation is necessary and as a consequence there is a lack of knowledge regarding minors on the part of the fiscal legal operators and defenders. Regarding legal professionals in juvenile criminal matters, the majority of them were found to be ignorant of the reforms to the Juvenile Penal Law. The penalties of the Juvenile Penal Law are the expression of media political factors such as policies of the Executive body to confront juvenile crime through the Heavy Hand Plans. The crimes that are executed through the Juvenile Penal Law are the result of a formulation of criminal policies but strictly repressive, leaving aside the most important element of childhood and adolescence, which consists of prevention where there is no an adequate preventive policy for juvenile delinquency. The Principle of Minimum Intervention is violated by criminalizing all those less serious crimes, closing the possibility of avoiding as far as possible that children and adolescents go to court.
