Abstract

RESUMEN: El presente trabajo de investigación para optar al título de Licenciatura en Ciencias Jurídicas se denomina: "La Protección del Patrimonio Histórico como Derecho Humano en la Ciudad de San Miguel". A lo largo de todos los capítulos de este trabajo de investigación se conocerán la mayor parte de hechos relevantes en cuanto al trabajo realizado a lo largo de los años por los diferentes tratados, convenios y pactos internacionales respecto al derecho humano de protección al patrimonio histórico. El objetivo principal de esta investigación es entonces, hacer un análisis de los mecanismos, leyes y medios adecuados para la protección del derecho a la cultura, en especial al derecho al patrimonio histórico como derecho humano, y lo que compete específicamente al Municipio de San Miguel, partiendo de un estudio histórico, doctrinario y teórico que permita hacer una aproximación de carácter jurídico a la concepción de la tutela y protección de dicho derecho, reconocer el carácter humano, tomando encuentra la universalidad de estos y la obligación del Estado para el cumplimiento y eficacia del mismo.se reflejan los resultados de la investigación, análisis de entrevistas, con este se pretende reflejar un poco de la realidad que acontece en el municipio de San Miguel, sobre el tema de cultura, dándole así un soporte para los objetivos planteados y las hipótesis construidas en el proyecto de investigación. encuentran las conclusiones y recomendaciones, las cuales luego del proceso de investigación y su duración, a través de documentos, entrevistas y demás medios para recolectar información, a través del análisis del nivel de cumplimientos de los instrumentos legales, la participación del Estado y el compromiso que se adoptó para la protección del derecho al patrimonio histórico, además de determinar de modo más estructurado cuales son los medios para el cumplimiento de dicho derecho y la importancia de estos en la construcción del resto de los derechos humanos, los mecanismos creados para tutelar la protección, su difusión y salvaguarda de los bienes. ABSTRACT: The present research work to qualify for the title of Bachelor of Legal Sciences is called: "The Protection of Historical Heritage as a Human Right in the City of San Miguel". Throughout all the chapters of this research work Most of the relevant facts will be known regarding the work carried out over the years by the different international treaties, conventions and pacts regarding the human right to protect historical heritage. The main objective of this research is then, to make an analysis of the appropriate mechanisms, laws and means for the protection of the right to culture, especially the right to historical heritage as a human right, and what is specifically the responsibility of the Municipality of San Miguel, based on a historical, doctrinal and theoretical study that allows make an approximation of a legal nature to the conception of the guardianship and protection of said right, recognize the human character, taking into account the universality of these and the obligation of the State for the fulfillment and effectiveness of the same. The results of the investigation are reflected, analysis of interviews, with this it is intended to reflect a bit of the reality that happens in the municipality of Sa n Miguel, on the subject of culture, thus giving him support for the stated objectives and the hypotheses built in the research project. Find the conclusions and recommendations, which after the investigation process and its duration, through documents, interviews and other means to collect information, through the analysis of the level of compliance with legal instruments, the participation of the State and the commitment that was adopted for the protection of the right to historical heritage, in addition to determining in a more structured way what are the means for the fulfillment of said right and the importance of these in the construction of the rest of human rights, the mechanisms created to protect the protection, dissemination and safeguarding of assets.
