Abstract

RESUMEN El presente trabajo de investigación trata sobre el proceso judicial de Alimentos a favor de la Mujer Embarazada, siendo este un tema de mucho interés social porque involucra el futuro del niño que está por nacer. Nuestra legislación en materia de Niñez y Adolescencia es muy flexible, pero con las mujeres embarazadas al momento de solicitar alimentos provisionales durante la etapa de gestación tiene como requisito presentar pruebas fehacientes que demuestren el vínculo filial para obtener la ayuda económica del supuesto padre. Es necesario partir de la problemática observada debido a que parte de la sociedad femenina no presenta demandas de alimentos en contra del padre de su bebe, debido a que el proceso de alimentos provisionales a favor de la mujer embarazada soltera tiene diversos obstáculos, entre ellos la dilatación de los procesos en los juzgados de familia, y el que se mencionó anteriormente debe establecer la filiación, pero en nuestra cultura la mayoría de hombres no se hacen responsables del embarazo voluntariamente, quedando así violentados los derechos del menor desde la gestación. En el desarrollo del tema de investigación se logró confirmar a través de las entrevistas realizadas a los jueces de los juzgados de familia y abogados en libre ejercicio que solo obtienen alimentos provisionales desde la gestación las mujeres embarazadas cuyos padres de sus bebes lo reconozcan voluntariamente, la otra mayoría no obtienen los alimentos hasta que nace el niño y se le realiza prueba de ADN. Palabras Claves: Mujer embarazada, Alimentos, Pago, Presunto, Gravidez.   ABSTRACT The present research work deals with the judicial process of Food in favor of Pregnant Women, this is a topic of great social interest because it involves the future of an unborn child. Our legislation on Children and Adolescents is very flexible, but with pregnant women, when requesting provisional food during the gestation stage, it is a requirement to provide reliable evidence that demonstrates the filial bond to obtain financial aid from the alleged father. It is necessary to start from the problem observed because part of our female society does not file alimony claims against the father of their baby, since the process of provisional alimony in favor of single pregnant women has various obstacles, amongst them the long terms in the family courts, and the previously mentioned must establish parentage, but in our culture most men do not voluntarily take responsibility for the pregnancy, thus violating the rights of the minor from the moment of gestation. In the development of the research topic, it was possible to confirm through the interviews carried out with the judges of the family courts and freelance lawyers that only pregnant women whose fathers of their babies voluntarily recognize them, were able to obtain provisional food from the moment of pregnancy, the other majority do not get food until the child is born and a DNA test is performed.
