Abstract

RESUMEN: Para la elaboración del análisis del tema investigativo, fue preciso hacer un despliegue de forma primaria sobre la teoría de los derechos fundamentales, en razón que el Estado, siendo que el ente jurídico tiene la obligación de velar por la seguridad de sus ciudadanos, no debe pasar inadvertido el hecho que, si una persona comete un ilícito penal, no pierde en ningún momento su valor como persona revestida del valor superior del ordenamiento jurídico, el cual es la dignidad humana. En ese orden de ideas, el Estado se ve forzosamente a formular leyes penales sin soslayar los derechos fundamentales de las personas. Por ello es que, en el Capítulo II se hace toda una enunciación de las funciones estatales respecto de la formulación de leyes penales ceñido a su poder punitivo, pero sin prescindir del respeto y las garantías fundamentales de las personas. Ese ius puniendi del Estado encuentra sus límites en todo Estado Constitucional de Derecho. Los derechos fundamentales resultan ser los límites a ese poder sancionador del Estado. En la estructura principal del desarrollo de esta temática, se profundizó en las granjas penitenciarias como un Programa dentro del Modelo Yo Cambio.En el Capítulo III se desarrollan y se exponen los resultados de las opiniones técnico jurídicas de los profesionales que se entrevistaron, lo cual sirvió en primer lugar para dejar por sentando de forma inequívoca que la única finalidad que deben tener las penas en los estados modernos es buscar la resocialización de las personas que infringen la Ley penal. Además, respecto de las granjas penitenciarias, los entrevistados emitieron una opinión positiva al tiempo que hacían énfasis en las limitantes con las que cuenta el referido programa de resocialización. ABSTRACT: For the elaboration of the analysis of the investigative topic, it was necessary to make a unfolding primarily on the theory of fundamental rights, in reason that the State, since the legal entity has the obligation to ensure the safety of its citizens, should not go unnoticed the fact that, if a person commits a criminal offense, does not lose at any time its value as person invested with the highest value of the legal system, which is human dignity. In this order of ideas, the State is forced to formulate criminal laws without avoiding the fundamental rights of people. That is why, in Chapter II, a complete enunciation of the State functions with respect to the formulation of criminal laws limited to its punitive power, but without disregarding the respect and fundamental guarantees of the people. This ius puniendi of the State finds its limits in every State Constitutional Law. Fundamental rights turn out to be the limits to that sanctioning power of the State. In the main structure of the development of this theme, prison farms were deepened as a Program within the Yo Cambio Model. Chapter III develops and presents the results of the technical-legal opinions of the professionals who were interviewed, which served in the first place to unequivocally establish that the only purpose that penalties should have in modern states is to seek the resocialization of people who violate criminal law. In addition, regarding the prison farms, the interviewees expressed a positive opinion while emphasizing the limitations of the aforementioned resocialization program.
